Terms of Service

1. Agreement

By using MotionSmile ("Service"), you agree to these Terms of Service. The Service is operated by Etapa Vanguarda, Lda., a company registered in Portugal ("Company", "we", "us").

2. Service Description

MotionSmile is an AI-powered tool that generates smile simulations for dental professionals. The Service uses artificial intelligence to create visual representations and should be used as a communication aid only, not as a guarantee of treatment outcomes.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account and all activity under it. You must be at least 18 years old to use the Service.

4. Subscription Plans

Free Trial: 2 patient generations (lifetime). No credit card required.
Starter: 10 patient generations per month. Monthly patients reset each billing cycle.
Pro: 20 patient generations per month. Monthly patients reset each billing cycle.
Studio: 40 patient generations per month. Monthly patients reset each billing cycle.
Patient Packs: One-time purchase of additional patient generations that never expire.

Unused monthly generations do not carry over to the next billing period. Patient Pack generations do not expire.

5. Payments and Billing

Subscriptions are billed monthly through Stripe. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. Refunds are handled on a case-by-case basis.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Upload images without proper consent from the individuals depicted
Misrepresent AI-generated results as guaranteed treatment outcomes to patients
Attempt to reverse-engineer, copy, or resell the Service
Share your account credentials with third parties

7. Intellectual Property

You retain ownership of images you upload. We retain ownership of the Service, its technology, and branding. Generated content may be used by you for professional purposes with your patients.

8. Disclaimer

The Service is provided "as is" without warranties of any kind. AI-generated smile simulations are approximations and do not guarantee specific dental treatment results. You are solely responsible for how you use and present generated content to patients.

9. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

10. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify registered users of material changes via email.

11. Governing Law

These Terms are governed by the laws of Portugal. Any disputes shall be resolved in the courts of Portugal.
